Once accepted, no other offers can be accepted, but interested parties can overbid the offer at a court hearing. A Baker Probate Court Hearing is scheduled by the lawyer for the Executor. The lawyer also arranges for Notice of the Hearing to be published at least 3 times over a minimum period of 8 days, starting at least 10 days before the sale.

This public Hearing is held in Baker Probate Court and at that time the judge will request bids. The minimum opening bid is defined in the "Report of Sale and Petition for Order Cornfirming Sale of Real Estate". This is typically 5% + $500 more than the original (offer) contract.

Baker For example, If the contract is for $100,000, the minimum bid allowed will be $105,500. At Baker Probate Court time the bidders are required to present a 10% cashier's check of their bid to the Baker Probate Court as a deposit.
